1. General Information and Definitions

1.1 About These Terms

These Terms and Conditions („Terms“) govern your use of the website https://ownovr.com („Website“) and the purchase of vintage clothing products („Products“) from OWNOVR („we“, „us“, „our“, „Seller“).

By accessing our Website or placing an order, you agree to be bound by these Terms, our Privacy Policy, and applicable laws including the Czech Civil Code (Act No. 89/2012 Coll.) and EU Consumer Rights Directive (2011/83/EU).

1.3 Definitions

„Consumer“ means a natural person who, when entering into and performing a contract, does not act within the scope of their business activity or independent performance of their profession.

„Buyer“ means any person (Consumer or business entity) who places an order through our Website.

„Contract“ means the purchase agreement concluded between the Seller and the Buyer for the purchase of Products.

„Products“ means vintage clothing items and accessories offered for sale on our Website.

„Order“ means the Buyer’s binding offer to purchase Products.

„Account“ means the Buyer’s user account on our Website.

2. Contractual Relationship

2.1 Nature of the Contract

The contractual relationship is governed by:

  • These Terms and Conditions
  • Czech Civil Code (Act No. 89/2012 Coll.)
  • Consumer Protection Act (Act No. 634/1992 Coll.)
  • Act on Certain Information Society Services (Act No. 480/2004 Coll.)
  • EU Consumer Rights Directive (2011/83/EU)
  • General Data Protection Regulation (GDPR)

2.2 Language

These Terms are provided in English. A Czech language version (Obchodní podmínky) is available upon request at support@ownovr.com.

The Contract is concluded in English and/or Czech, according to the Buyer’s preference selected during the order process.

2.3 Amendments to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on our Website with an updated „Last Updated“ date.

Orders placed before the change will be governed by the Terms in effect at the time of order placement.

We will notify registered users of material changes via email at least 14 days before the changes take effect.

2.4 Archiving of Contracts

We archive all concluded Contracts for a period of 7 years in accordance with Czech accounting regulations. Contracts are stored securely and are not accessible to unauthorized third parties.

Buyers can access their order history and contracts through their Account on our Website.

3. User Account

3.1 Account Registration

Buyers may register for an Account on our Website by providing:

  • Full name
  • Email address
  • Password
  • Shipping address
  • Optional: Phone number, date of birth

Registration is voluntary. Buyers can make purchases as guests without creating an Account.

3.2 Account Security

Buyers are responsible for:

  • Maintaining the confidentiality of their Account credentials
  • All activities that occur under their Account
  • Immediately notifying us of any unauthorized access

We are not liable for losses resulting from unauthorized Account use, except where such use results from our negligence.

3.3 Account Termination

By Buyer: You may terminate your Account at any time by contacting support@ownovr.com or through Account settings.

By Seller: We may suspend or terminate Accounts that violate these Terms, engage in fraudulent activity, or for other legitimate reasons. We will provide notice and explanation unless immediate termination is required by law or security concerns.

Upon termination, your personal data will be handled according to our Privacy Policy and data retention obligations.

4. Products and Product Information

4.1 Product Descriptions

All Products are vintage clothing items. We make every effort to accurately describe Products, including:

  • Type of garment
  • Brand (if identifiable)
  • Approximate age/era
  • Size (measurements provided)
  • Material/fabric composition (if known)
  • Condition (including any wear, damage, or defects)
  • Color
  • Care instructions

4.2 Product Photography

Product images are our own photographs of actual items. We strive for accurate color representation, but actual colors may vary slightly due to:

  • Monitor/screen settings
  • Lighting conditions during photography
  • Natural variations in vintage fabrics

4.3 Vintage Nature of Products

Important Notice: All Products are vintage/second-hand items. By their nature, they may show signs of previous wear, including:

  • Minor stains or discoloration
  • Small holes or loose threads
  • Fading
  • Odors (we clean items, but vintage fabrics may retain slight odors)
  • Missing buttons or fasteners
  • Alterations from original state

We disclose all known defects in Product descriptions. However, some minor imperfections inherent to vintage items may not be individually listed.

4.4 Sizing Information

Vintage sizing differs from modern sizing standards. We provide actual measurements (in centimeters) for:

  • Chest/bust
  • Waist
  • Hips
  • Length
  • Sleeve length
  • Shoulder width

Important: Do not rely on labeled sizes. Always check measurements before ordering.

4.5 Product Availability

All Products are unique, one-of-a-kind vintage items. Each Product is available in quantity of one (1) only.

Products displayed on the Website are subject to availability. If an ordered Product becomes unavailable after order placement, we will notify you immediately and offer:

  • Full refund
  • Alternative similar Product (if available)

We are not liable for Products that become unavailable after order placement but before fulfillment.

4.6 Pricing

All prices are stated in:

  • Czech Koruna (CZK)
  • Euro (EUR)
  • [Other currencies as applicable]

Prices include:

  • ✓ VAT (as applicable under Czech law)
  • ✗ Shipping costs (shown separately)
  • ✗ Customs duties for non-EU deliveries (Buyer’s responsibility)

We reserve the right to change prices at any time. Orders are charged at the price displayed at the time of order confirmation, not at the time of browsing.

Price Errors: If we discover a pricing error after you’ve placed an order, we will notify you and give you the option to:

  • Proceed with the order at the correct price
  • Cancel the order and receive a full refund

5. Order Process

5.1 How to Place an Order

Step 1: Add to Cart
Select desired Products and add them to your shopping cart.

Step 2: Review Cart
Review your selected items, quantities, and total price.

Step 3: Provide Information
Enter or confirm:

  • Shipping address
  • Billing address (if different)
  • Contact information (email, phone)
  • Shipping method preference

Step 4: Select Payment Method
Choose from available payment options (see Section 7).

Step 5: Review Order Summary
Before submitting, you will see a final summary including:

  • Product details and prices
  • Shipping costs
  • Total amount (including VAT)
  • Estimated delivery time
  • Selected payment method

Step 6: Confirm Order
Click the „Place Order“ or „Complete Purchase“ button.

⚠️ Important: Clicking this button constitutes a binding offer to purchase.

5.2 Order Confirmation

Upon successful order placement, you will receive an Order Confirmation Email at the provided email address containing:

  • Order number
  • Date and time of order
  • Itemized list of Products
  • Prices and total amount
  • Shipping address
  • Estimated delivery timeframe
  • Payment instructions (if applicable)
  • Link to these Terms and Conditions

Contract Formation: The Contract is concluded when we send the Order Confirmation Email. This typically occurs within 24 hours of order placement.

If you do not receive a confirmation email within 24 hours, check your spam folder and contact us at support@ownovr.com.

5.3 Order Acceptance

We reserve the right to refuse or cancel orders in the following circumstances:

  • Product no longer available
  • Pricing or Product description error
  • Suspected fraudulent activity
  • Incomplete or incorrect information provided
  • Breach of these Terms
  • Buyer located in a country we don’t ship to

If we cancel your order, you will receive a full refund of any payments made.

5.4 Order Modifications and Cancellation

By Buyer:

You may modify or cancel your order before shipment by contacting us immediately at support@ownovr.com with your order number.

Once an order has been shipped, it cannot be cancelled (but you retain withdrawal rights – see Section 10).

By Seller:

We may cancel orders for reasons listed in Section 5.3. You will be notified promptly and receive a full refund.

6. Shipping and Delivery

6.1 Shipping Areas

We ship to:

  • ✓ All EU member states
  • ✓ United Kingdom
  • ✓ Switzerland
  • ✓ Norway

We do not currently ship to addresses outside these areas.

6.2 Shipping Methods

Czech Republic:

  • Standard Shipping (Czech Post/Zásilkovna): 3-5 business days
  • Express Shipping (DHL Express): 1-2 business days

EU Countries:

  • Standard Shipping: 5-10 business days
  • Express Shipping: 2-5 business days

Non-EU Countries:

  • International Standard: 7-14 business days
  • International Express: 3-7 business days

Delivery times are estimates and not guaranteed. Actual delivery may be affected by customs clearance, holidays, or carrier delays.

6.3 Shipping Costs

Shipping costs are calculated based on:

  • Destination country
  • Shipping method selected
  • Package weight and dimensions

Exact shipping costs are displayed during checkout before order confirmation.

Free Shipping: We offer free standard shipping on orders over [amount] within the Czech Republic.

6.4 Delivery Process

Tracking: Once your order ships, you will receive a Shipping Confirmation Email containing:

  • Tracking number
  • Carrier information
  • Estimated delivery date
  • Link to track your shipment

Delivery Attempts: Carriers typically make 2-3 delivery attempts. If delivery is unsuccessful:

  • You will receive a notice with pickup instructions
  • Package may be held at a local post office or pickup point
  • Unclaimed packages are returned to us after [X] days

Failed Delivery: If a package is returned to us due to:

  • Incorrect address provided by Buyer
  • Buyer refused delivery
  • Buyer failed to collect package

You are responsible for additional shipping costs for redelivery. We may deduct these costs from any refund.

6.5 Risk of Loss

Risk of loss or damage passes to you upon delivery. Until delivery, we bear the risk of loss or damage during transit.

If your package appears damaged upon delivery, you should:

  1. Note the damage with the carrier
  2. Take photos of the package and contents
  3. Contact us immediately at support@ownovr.com

We will work with you and the carrier to resolve the issue.

6.6 Non-EU Deliveries – Customs and Import Duties

For all orders shipped to countries outside the European Union (including UK, USA, Switzerland, Norway, etc.):

If you refuse a shipment due to unexpected import fees, taxes, or for any other reason:

You are liable for the cost of returning the package to our HQ in the Czech Republic. These costs will be deducted from your refund. WARNING: If the return shipping and administrative costs exceed the value of the merchandise, the package will be abandoned by the carrier and you will receive NO REFUND.

You are liable for the original shipping charges.

You are liable for any import fees incurred on the package.

We are not responsible for delays caused by customs processing.

7. Payment

7.1 Payment Methods

We accept the following payment methods:

Credit/Debit Cards:

  • Visa
  • Mastercard
  • American Express

Online Payment Services:

  • PayPal
  • Apple Pay
  • Google Pay

Bank Transfer:

  • SEPA transfer (for EU customers)
  • Czech bank transfer

Cash on Delivery (COD):

  • Available for Czech Republic only
  • Additional COD fee applies: (calculated at check out)

7.2 Payment Processing

Card and Online Payments: Payment is processed immediately upon order confirmation. Funds are authorized and captured by our payment processor.

Bank Transfer: You will receive payment instructions in the Order Confirmation Email. Payment must be received within 7 days of order confirmation, or the order will be automatically cancelled.

Cash on Delivery: Payment is made to the delivery carrier upon receipt of the package.

7.3 Payment Security

All online payments are processed securely through:

  • Stripe (PCI DSS Level 1 certified)
  • PayPal (PCI DSS compliant)

We do not store your payment card details on our servers. All payment information is encrypted using SSL/TLS technology.

7.4 Currency

Prices are displayed in CZK, EUR, or other currencies as selected. You will be charged in the currency shown during checkout.

For international cards, your bank may apply currency conversion fees. We are not responsible for these additional charges.

7.5 Invoices

A VAT invoice (if applicable) or receipt will be:

  • Sent to your email address after payment confirmation
  • Available in your Account order history
  • Included in the package (if requested)

For business customers requiring specific invoice details, please provide your company information during checkout or contact us before ordering.

8. Ownership and Retention of Title

Ownership of Products passes to you upon full payment of the purchase price.

Until full payment is received, we retain ownership of the Products (retention of title). This does not affect your right of withdrawal.

9. Product Quality and Conformity

9.1 Conformity with Contract

Products must conform to the Contract at the time of delivery. Products conform to the Contract if they:

  • Match the description provided
  • Are fit for the purposes stated
  • Possess the qualities and characteristics described
  • Are in the condition stated (considering their vintage nature)

9.2 Vintage Nature – Special Considerations

You acknowledge that you are purchasing a vintage, second-hand item. Vintage items are sold „AS IS“. The following are considered characteristics of the Product and NOT defects:

Cracking on prints due to age. By placing an order, you explicitly accept these conditions. Claims based on these characteristics will be rejected.

  • Natural fading of fabrics.
  • Minor loose threads or pilling.
  • Micro-holes (pinholes) not visible from 30cm distance.
  • „Vintage odor“ (musty smell associated with age and storage).

9.3 Seller’s Liability for Defects

Time Limit: We are liable for defects in conformity for 24 months from delivery (as required by Czech and EU law), considering the vintage nature of the Products.

Defects Must Be:

  • Present at the time of delivery (not damage caused by Buyer’s use)
  • Not disclosed in the Product description
  • Material (affecting usability or value)

9.4 Notification of Defects

You must notify us of any defects:

  • Immediately upon discovery
  • At the latest within 2 months of discovering the defect
  • Within the 24-month liability period

Failure to notify within 2 months of discovery may result in loss of rights.

How to Notify: Contact support@ownovr.com with:

  • Order number
  • Product description
  • Description of the defect
  • Photos clearly showing the defect
  • Date when defect was discovered

10. Consumer Right of Withdrawal (14-Day Return Policy)

10.1 Scope of Withdrawal Rights For EU/EEA Consumers:

The right of withdrawal (14-day return period) described in this Section 10 applies exclusively to Consumers residing in member states of the European Union (EU) and the European Economic Area (EEA).

For Non-EU/International Consumers: For customers residing outside the EU/EEA (including but not limited to USA, Canada, Australia, Asia), ALL SALES ARE FINAL. We do not accept returns or exchanges for change of mind, wrong size, or fit issues. Returns are only accepted if the Product is significantly not as described (see Section 11).

10.2 Withdrawal Period

You have 14 calendar days to withdraw from the Contract without giving any reason.

The withdrawal period starts:

  • For Products: The day you (or a third party you designate, other than the carrier) acquire physical possession of the goods

Extended Period: If we fail to inform you of your withdrawal right, the period is extended to 12 months from the original deadline.

10.3 How to Exercise Withdrawal Right

To exercise your right of withdrawal, you must inform us of your decision by an unequivocal statement (clear declaration):

  • Your name and contact details
  • Order number
  • Date of order and/or receipt
  • Description of Products being returned
  • Reason for return (optional but helpful)

Withdrawal Form: You may use the model withdrawal form provided at the end of these Terms (Annex I), but it is not obligatory.

10.4 Deadline for Notification

To meet the withdrawal deadline, it is sufficient to send your notification before the 14-day period expires.

Example: If you received the Product on November 1, you must send your withdrawal notification by November 15 at the latest.

10.5 Return of Products

Return Deadline: You must return the Products to us within 14 days from the day you notify us of your withdrawal.

Return Shipping Costs: You bear the direct cost of returning the Products unless:

  • We agreed to bear the cost
  • We failed to inform you that you must bear the cost

Return Method:

  • Use a trackable shipping method
  • Package Products securely to prevent damage during transit
  • Include a note with your order number and reason for return

We recommend using registered/tracked mail and retaining proof of postage.

10.6 Product Condition for Returns

You are only liable for any diminished value of the Products resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Products.

What is Allowed: ✓ Trying on clothing to check size and fit
✓ Examining the Product as you would in a physical store
✓ Removing tags temporarily to try on (but preserve them)

What is Not Allowed: ✗ Wearing Products outdoors or for extended periods
✗ Washing or altering Products
✗ Removing or discarding original tags permanently
✗ Causing damage, stains, or odors
✗ Smoking or exposing Products to strong scents while in your possession

Rejection of Returns: We may refuse returns or deduct from your refund if Products are returned:

  • With signs of wear beyond normal try-on
  • Damaged, stained, or soiled
  • Without original tags (if possible to preserve)
  • With strong odors (smoke, perfume, etc.)
  • Washed or altered

10.7 Refund Process

Refund Timing: We will reimburse all payments received from you, including:

  • Product price
  • Standard delivery costs (if you paid for shipping)

We will issue the refund within 14 days from the day we receive:

  • Your withdrawal notification, OR
  • The returned Products (if earlier), OR
  • Proof that you have sent back the Products (if earlier)

Refund Method: We will use the same means of payment you used for the original transaction, unless you expressly agree otherwise. You will not incur any fees as a result of the refund.

Delivery Cost Refund: We will refund the standard delivery cost. If you chose expedited shipping, we are only required to refund the cost of standard delivery.

Withholding Refund: We may withhold the refund until we have received the Products back or you have provided proof of return, whichever is earliest.

10.8 Exceptions to Withdrawal Right

The right of withdrawal does not apply to:

Products that have been worn beyond try-on (due to hygiene and nature of vintage clothing)
Products that are inseparably mixed with other items after delivery (not applicable to our Products)
Custom or personalized Products (if we offer such services in the future)
Products that can deteriorate or expire rapidly (not applicable to our Products)
Sealed goods that were unsealed and cannot be returned for health/hygiene reasons (if applicable to specific Products)

10.9 Withdrawal Form Template

See Annex I at the end of these Terms for the Model Withdrawal Form.

11. Complaints Procedure (Defective Products)

This section describes the procedure for making complaints about defective Products, separate from the right of withdrawal.

11.1 Seller’s Liability

We are liable for defects in Products for 24 months from delivery in accordance with Czech Civil Code (Sections 2161-2174).

11.2 Consumer Rights in Case of Defects

If a Product does not conform to the Contract, you may:

1. Request Repair or Replacement (your choice)

  • We must remedy the defect free of charge
  • We must remedy the defect within a reasonable time
  • We must remedy the defect without significant inconvenience to you

We may refuse your choice if it is impossible or disproportionately costly compared to the alternative remedy.

3. Withdraw from the Contract (if the defect is material)

Material defects include:

  • Products cannot be used as intended
  • Defect prevents normal use
  • Defect was present at time of sale and you would not have bought the Product had you known

11.3 Time Limits for Complaints

Notification: You must notify us of the defect within 2 months of discovering it.

Complaint Period: Complaints must be made within the 24-month liability period from delivery.

Defects Appearing:

  • Within 6 months of delivery: Presumed to exist at time of delivery (burden of proof on Seller)
  • After 6 months of delivery: You must prove defect existed at time of delivery

11.4 How to File a Complaint

Step 1: Notify Us

Contact us as soon as you discover a defect:

  • Email: support@ownovr.com
  • Subject line: „Product Complaint – Order #[your order number]“

Required Information:

  • Your contact information
  • Order number and date
  • Product description
  • Detailed description of the defect
  • Clear photos showing the defect
  • Date when defect was discovered
  • Your desired remedy (repair, replacement, discount, or withdrawal)

Step 2: Return Product (if requested)

We may request you return the Product for inspection. Return shipping will be at our expense for valid complaints.

Step 3: Evaluation

We will evaluate your complaint and respond within 30 days of receipt with:

  • Acknowledgment of the defect (or rejection with reasoning)
  • Proposed remedy
  • Timeline for resolution

Step 4: Resolution

If we accept the complaint:

  • Repair: We will repair the Product or provide repair service
  • Replacement: We will send a replacement Product of equal value
  • Discount: We will issue a partial refund
  • Withdrawal: We will issue a full refund and you return the Product

11.5 Complaint Record

For each complaint, we will issue a Complaint Record (Reklamační protokol) documenting:

  • Date of complaint
  • Description of the defect
  • Consumer’s requested remedy
  • Method and date of handling the complaint
  • Result of the complaint

You will receive the Complaint Record:

  • Immediately upon filing (for in-person complaints)
  • By email within 3 business days (for online complaints)

11.6 Complaint Resolution Timeline

We will handle complaints within 30 days of receipt unless we agree on a longer period with you.

If we exceed 30 days without justification, you may:

  • Withdraw from the Contract
  • Request a reasonable discount

11.7 Unjustified Complaints

If a complaint is unjustified (defect does not exist or was caused by Buyer):

  • We will notify you with explanation
  • We may charge return shipping costs
  • You may be responsible for evaluation/testing costs

11.8 Out-of-Court Dispute Resolution

If you are dissatisfied with our handling of your complaint, you may use alternative dispute resolution:

12. Limitation of Liability

12.1 Seller’s Liability

We are liable for:

  • ✓ Breach of Contract obligations
  • ✓ Defects in Products (within 24-month period)
  • ✓ Damage caused by our negligence or intentional acts
  • ✓ Non-conformity with Product descriptions we provided

12.2 Limitations (where permitted by law)

To the extent permitted by applicable law:

Vintage Nature of Products: We are not liable for characteristics of Products that are:

  • Disclosed in the Product description
  • Inherent to vintage/second-hand items
  • Normal wear consistent with the Product’s age

Indirect Damages: We are not liable for indirect or consequential damages, including but not limited to:

  • Lost profits
  • Business interruption
  • Loss of data
  • Costs of substitute products

Third-Party Actions: We are not liable for:

  • Carrier delays or damage during shipping (unless caused by our negligence)
  • Payment processor errors or service interruptions
  • Force majeure events (see Section 15.2)

12.3 Consumer Rights

Nothing in these Terms limits or excludes:

  • Your statutory rights under Czech or EU consumer protection law
  • Our liability for death or personal injury caused by negligence
  • Our liability for fraud or fraudulent misrepresentation
  • Any other liability that cannot be limited under applicable law

13. Intellectual Property

13.1 Ownership

All content on the Website is owned by or licensed to us, including:

  • Website design and layout
  • Product photographs and descriptions
  • Logos, trademarks, and brand names
  • Text, graphics, and software
  • Overall „look and feel“

This content is protected by copyright, trademark, and other intellectual property laws.

13.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Website for personal, non-commercial purposes only.

You May Not:

  • Reproduce, distribute, or publicly display our content
  • Modify, adapt, or create derivative works
  • Use content for commercial purposes without our written permission
  • Use automated tools (bots, scrapers) to access or collect data from the Website
  • Frame or mirror any part of the Website
  • Reverse engineer or attempt to extract source code

13.3 User-Generated Content

If you submit reviews, comments, or other content to our Website:

  • You grant us a worldwide, royalty-free, perpetual license to use, display, and distribute such content
  • You represent that you own or have rights to the content submitted
  • You waive any moral rights in such content
  • You will not submit content that infringes third-party rights or violates laws

We reserve the right to remove any user-generated content that violates these Terms or applicable laws.

OWNOVR and our logo are trademarks of Ilya Makarov. All rights reserved.

14. Prohibited Uses

You agree not to use the Website or our services to:

Illegal Activities:

  • ❌ Violate any applicable laws or regulations
  • ❌ Engage in fraudulent activities
  • ❌ Infringe intellectual property rights

Harmful Conduct:

  • ❌ Transmit viruses, malware, or harmful code
  • ❌ Attempt to gain unauthorized access to our systems
  • ❌ Interfere with or disrupt the Website or servers
  • ❌ Engage in denial-of-service attacks

Misuse:

  • ❌ Impersonate others or provide false information

15. General Provisions

15.1 Governing Law

These Terms and any Contracts concluded are governed by the laws of the Czech Republic.

For Non-EU Consumers: To the fullest extent permitted by applicable law, you agree to submit to the exclusive jurisdiction of the courts of the Czech Republic (District Court in České Budějovice) for any disputes.

Exclusion of CISG: The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

For EU Consumers: You benefit from mandatory consumer protection provisions of your country of residence.

15.2 Force Majeure

We are not liable for delays or failures to perform our obligations due to circumstances beyond our reasonable control, including:

  • Natural disasters (floods, earthquakes, fires)
  • War, terrorism, civil unrest
  • Government actions, embargoes, sanctions
  • Labor strikes or disputes
  • Failure of utilities or telecommunications
  • Pandemic or epidemic
  • Supplier or carrier failures

During force majeure events, our performance obligations are suspended. If the event continues for more than 30 days, either party may terminate the Contract with a full refund.

15.3 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the use of our Website and purchase of Products.

These Terms supersede any prior agreements, representations, or understandings (whether oral or written).

15.4 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable:

  • The remaining provisions remain in full force and effect
  • The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable
  • If modification is not possible, the provision will be severed

15.5 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Any waiver must be in writing and signed by an authorized representative.

15.6 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations to:

  • An affiliate or subsidiary
  • A purchaser of our business or assets
  • Any other party with your consent

15.7 Third-Party Rights

These Terms are between you and us. No third party has any rights to enforce any provision of these Terms.

15.8 Notices

To You: We will send notices to the email address or physical address you provided during order placement or registration.

Notices are deemed received:

  • Email: When sent (unless delivery failure notification received)
  • Mail: 5 business days after posting

15.9 Survival

Provisions that by their nature should survive termination will survive, including:

  • Sections 8 (Ownership), 9 (Product Quality), 11 (Complaints), 12 (Limitation of Liability), 13 (Intellectual Property), 16 (Dispute Resolution)

15.10 Language

These Terms are drafted in English. A Czech translation (Obchodní podmínky) is available at [link] or upon request.

In case of discrepancy between language versions, the Czech version prevails for Czech consumers.

16. Dispute Resolution

16.1 Informal Resolution

Before initiating formal proceedings, we encourage you to contact us at legal@ownovr.com to resolve disputes informally.

We are committed to working with you in good faith to reach a mutually satisfactory resolution.

16.2 Negotiation and Mediation

If informal resolution fails, we agree to attempt resolution through:

  • Direct negotiation between parties
  • Mediation by a neutral third party

Mediation services are available through Czech consumer protection organizations.

16.3 Jurisdiction for Consumers

Czech Consumers: You may bring legal proceedings in:

  • The competent court in your district of residence, OR
  • The competent court in our registered seat

We may only bring proceedings against you in the court of your residence.

EU Consumers (outside Czech Republic): You have the right to bring proceedings in the courts of your country of residence or the Czech Republic, in accordance with EU Regulation 1215/2012 (Brussels I Recast).

16.4 Jurisdiction for Business Buyers

For business buyers (non-Consumers), the exclusive jurisdiction is the courts of Prague, Czech Republic.

16.5 Online Dispute Resolution (ODR)

EU Consumers can use the European Commission’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

This platform facilitates out-of-court resolution of disputes concerning online purchases.
